Acceptable Use Policy

Effective Date: September 1, 2026

⚠ LEGAL REVIEW REQUIRED This is a template drafted to SaaS industry standards and Florida Bar considerations. Before publishing, have it reviewed by outside counsel competent in SaaS contracts, Florida privacy law, and legal-industry regulatory requirements.

This Acceptable Use Policy (AUP) supplements the Terms of Service. By using Trial Commander, you agree to comply with this AUP.

Permitted Use

Trial Commander is for:

  • Law firms and licensed attorneys conducting legal practice
  • Paralegals and firm staff acting under attorney supervision
  • Clients accessing the client portal for their own matters

Prohibited Conduct

You agree NOT to:

Security & Integrity:

  • Attempt to probe, scan, or test vulnerabilities of the Service
  • Circumvent security measures, rate limits, or access controls
  • Upload malware, viruses, or code designed to disrupt the Service
  • Attempt to access data belonging to other customers
  • Reverse engineer, decompile, or disassemble the Service
  • Use automated scraping tools or bots (except authorized integrations)

Fraud & Misrepresentation:

  • Provide false information when signing up or using the Service
  • Impersonate another person or entity
  • Misrepresent your affiliation with a person or organization
  • Create multiple accounts to evade trial limits or bans

Legal Compliance:

  • Use the Service to engage in unauthorized practice of law
  • Use the Service to circumvent Florida Bar rules, including trust account requirements
  • Use the Service for matters involving money laundering, fraud, or illegal activity
  • Upload content that violates intellectual property rights of others
  • Use the Service in violation of any applicable law (federal, state, local, international)

AI Features:

  • Submit content designed to elicit harmful, illegal, or discriminatory AI output
  • Use AI features to generate content you will falsely present as your own independent legal analysis
  • Use AI output without the review and supervision required by Florida Bar Rule 4-5.3
  • Submit third-party information to AI without authorization

Data & Privacy:

  • Upload content that violates attorney-client privilege of others (not your own clients)
  • Upload health information (PHI) without an executed Business Associate Agreement with us
  • Use the Service to surveil or stalk individuals
  • Share login credentials with persons outside your firm

Commercial:

  • Resell the Service without our written consent
  • Use the Service to provide services competitive to ours
  • Use the Service for commercial purposes other than your own legal practice

Ethical:

  • Use the Service to harass or harm clients, opposing parties, or witnesses
  • Use the Service to deceive a court or tribunal
  • Violate court orders (e.g., protective orders, seal orders) using the Service

Enforcement

We may take the following actions in response to violations:

For minor violations: Warning and opportunity to cure For ongoing violations: Suspension of offending features For serious or repeat violations: Account termination without refund For illegal conduct: Reporting to law enforcement and/or The Florida Bar

We investigate suspected violations. We may require you to provide information to confirm compliance.

Reporting Violations

If you become aware of a violation of this policy or suspicious activity, email abuse@trialcommander.com.

We do not retaliate against good-faith reports.

Bar Complaints and Regulatory Cooperation

We cooperate with Florida Bar investigations and grievance proceedings. We will respond to valid subpoenas and Bar inquiries regarding:

  • User account information
  • Audit logs for specific actions
  • Data processing records

Where legally permitted, we will notify the affected firm of such requests before responding, to allow them to object or take protective measures.

Changes

We may update this AUP on 30 days' notice. Material changes require customer opt-in.
